Unocal Corporation, the California-based giant gas-and-petroleum corporation, will face trial in a United States court on charges of forced labour of Burmese people to build the $1. 2 billion Yadana Gas Pipeline Project in southern Burma. On September 18 last year(2012), a panel of the U. S. Ninth Circuit Court of Appeals in Pasadena reversed a previous Federal District Court decision and allowed the groundbreaking human rights lawsuit against Unocal to go forward. In the Doe v. Unocal case, 11 Burmese villagers are suing Unocal for human rights abuses including rape, forced labour and murder during the building of the Yadana gas pipeline project in Burma. This is a landmark decision, said Richard L. Herz, an attorney with the non-profit group EarthRights International (ERI), co-counsel in the lawsuit. In recognising that corporations that aid and abet egregious human rights abuses can be held accountable, the Ninth Circuit has affirmed that U. S. corporations cannot violate international human rights with impunity. The decision said that plaintiffs need only demonstrate that Unocal knowingly assisted the military in the perpetration of the abuses, and that they had done so. The court also found that forced labour such as that employed by the Burmese military on behalf of the Unocal pipeline is the modern equivalent of slavery. The ruling stated, The evidence supports the conclusion that Unocal gave `practical assistance to the Myanmar Military in subjecting Plaintiffs to these acts of murder and rape. Thus, because Unocal knew that acts of violence would probably be committed, it became liable as an aider and abettor when such acts of violence, — specifically, murder and rape — were in fact committed. The legal battle began six years ago when Burmese villagers filed a suit in U. S. federal court demanding that Unocal pay millions of dollars in damages for abuses committed by soldiers along the Yadana pipeline. However, in 2000, despite the court finding evidence that Unocal knew that forced labour was being utilised and that the joint venturers benefited from the practice, the  federal judge dismissed the case because the companys conduct did not rise to the level of active participation — a liability standard borrowed from the Nuremberg war crimes trials involving the role of German industrialists in the Nazi forced-labour programme. Lawyers for the Burmese villagers responded by filing a new lawsuit under state law and making many of the same charges in the Superior Court in Los Angeles. In June 2002, the California Superior Court Judge Victoria Chaneys decision held that plaintiffs claims might proceed to trial. The trial of the California State case is scheduled to start in early 2003. The lawyers for the Burmese villagers also appealed the federal judges dismissal last year, which led to the ruling by the Ninth Circuit Court on September 18 last year. Although the Ninth Circuit Court has sent the case back to the lower federal court for trial, the villagers lawyers said they would ask Superior Court Judge Victoria Gerrard Chaney to apply the new liability standard in the California State trial. Unocal maintains that its actions are not on trial in the California case and that the company expects to be vindicated of `vicarious liability charges. Responding to the federal decision, Unocals lawyer Daniel M. Petrocelli said: What the case is about is whether a private American company can be held responsible for the actions of a foreign military regime when the company itself didnt do any of the offending conduct. No Unocal person participated in any acts of wrongdoing, Petrocelli said. Unocal does not have, nor ever had, any control over the actions of the Myanmar military. The company does not direct, countenance or condone the violation of any persons human rights, and it certainly did not aid or abet the violation of anyones human rights. And if that is the standard that is applied in this case, we are confident we will meet that standard. During the early 1990s, ignoring widespread calls from the Burmese democracy leader Aung San Suu Kyi and pro-democracy groups worldwide for a moratorium on international investment, transnational oil companies Unocal (U. S. ) and Total (France) chose to invest in a regime with one of the worst human rights and environmental records in the world. In 1992, the Burmese military government entered into a joint venture with Unocal and Total to construct a gas pipeline from the Yadana gas fields in Burmas Gulf of Martaban to the Thai border. This represents the single largest foreign investment project in Burma. The Yadana gas revenue is one of the largest sources of foreign capital for the Burmese military government. The Burmese military regime was contracted by the oil companies to provide security for the project. Ever since, the Burmese army has engaged in systematic human rights abuses and environmental degradation in order to fulfil its contractual responsibilities. The U. S. court accepted the case against Unocal based on extensive documentation including eyewitness accounts of human rights abuses in the pipeline region provided by ERI. Along the Burmese pipeline route, killings, torture, rape and extortion by pipeline security forces have increased sharply since the Yadana Project was initiated. Many villagers along the pipeline area provided eye-witness descriptions of forced labour: Battalion No.  273 came in to our village and asked for two porters to go to two places, including one located directly along the pipeline. These people had to go because it was their turn. The soldiers ordered a total of 18 porters from our village tract. The work lasted about 20 days, and they did not get any payment. I know they did not get payment because that was always the case, and it was the same again. The influx of soldiers in the previously isolated Tenasserim region also caused an increase in illegal hunting, logging, and wildlife trade. The region is one of the largest rainforest tracts left in mainland Southeast Asia, home to wild elephants, tigers, rhinos and great hornbills, to name just a few rare and important species. It is also home to numerous indigenous peoples, including the Mon, Karen, and Tavoyans. An incriminating piece of evidence is a declassified cable sent from the U. S. Embassy in Rangoon to the U. S. State Department in 1995 that confirms Unocals relationship with the Burmese military and their collusion in forced labour. Known as the Robinson Cable, the cable chronicles a meeting between the U.S. embassy staff and Joel Robinson, Unocals manager for special projects. According to the cable, Robinson accepts Unocals relationship with the Burmese military: On the general issue of the close working relationship between Total/Unocal and the Burmese military, Robinson had no apologies to make. He stated forthrightly that the companies have hired the Burmese military to provide security for the project and pay for this through the Myanmar Oil and Gas Enterprise (MOGE). He said three truckloads of soldiers accompany project officials as they conduct survey work and visit villages. He said Totals security officials meet with military counterparts to inform them of the next days activities so that soldiers can ensure the area is secure and guard the work perimeter while the survey team goes about its business. Tyler Giannini of ERI said that the evidence belies Unocals claims that it is not responsible for the acts of the Burmese military. When Unocal and Total hire the military, tell them where to go, what to do, and depend on them for the security of their project, they are morally and legally responsible for the abuses that their security forces commit. Unocal was dealing with the devil. Now they will have to answer to a jury, he said. Doe v. Unocal is the first case in U. S. history in which a corporation will stand trial for human rights abuses committed abroad. Human rights lawyers have viewed the court decision on Unocal as a breakthrough for foreigners seeking to hold multinational corporations accountable for their alleged complicity with repressive regimes in human rights abuses. But as soon as the conflict is revealed to the readers and the other characters in the novel, they all get to see the real side of the character. Bogart Bogart is the first character that the readers are introduced to. He has no identity and it is ironic how his mysteriousness is accepted unquestioningly by the people of Miguel Street. He was first named Patience just because he plays a cards game called Patience all day and then he is given the name Bogart because of his resemblance to an actor in a movie called Casablanca. He comes to Miguel Street from somewhere and becomes the most popular man in the street at one point as the narrator boy says on page 11 He was at one time quite the most popular man in the street. Bogart creates a fake identity of himself in Miguel Street and never tells anyone about his real story, about his problem or conflict that he is facing. In fact he goes way out of his real life into fantasy which is apparent when he explains where he had disappeared to, on page 14 He had got a job on a ship and had gone to British Guiana. There he had deserted, and gone into the interior. He became a cowboy on the Rupununi, smuggled things into Brazil, and had gathered some girls from Brazil and taken them to Goergetown. He was running the best brothel in the town when the police treacherously took his bribes and arrested him. So he creates this fake identity of himself. However everything is revealed altogether when he is arrested under the charge of bigamy. He had left his first wife in Tunapuna because they could not have any children which questioned his manhood. So to avoid reality he ran away and came to Miguel Street. Then after some time he goes away and makes a baby with a Caroni Girl, Bogart still returns to Miguel Street to be a man as Hat explains at the end. POPO Popo story is quiet similar to Bogarts. He is also at first seen as a happy person. He also creates a fake identity of himself for self-amusement. He calls himself a carpenter and pretends to be busy building a thing without a name. He doesnt do anything for living and depends entirely on his wife who is employed as a cook. He shows off his prosperity in life and his status as a carpenter. He stands in the sun every morning with a glass of rum which he doesnt drink, he just holds it and when someone passes by he dips his fingers and licks them and waves at the person which shows that he is just showing off and enjoys himself being envied by other characters in the Miguel Street. However, when his conflict comes up the readers and the other characters in Miguel Street get to see a new character of Popo. His wife suddenly runs away with a gardener in her workplace and it is after that a change in Popos life-style is seen. It is also from there the readers and the other characters learn about Popo. He is no longer a man to be envied and then he disappears from Miguel Street just like Bogart and beats the guy with whom his wife had run away. The parents wanted to know the future of the child so they had an oracle tell them a prophecy. The prophecy told them that he will kill his father and marry his mother. To protect themselves the parents sent the baby away to be killed. However, the child is not killed. Instead he is sent to another kingdom to be raised by a different king and queen. The new parents never tell Oedipus that he is not theirs. When Oedipus hears he is to kill his father and marry his mother, he leaves his parents and searches for a new home. While on the road after leaving his home Oedipus runs into a man. Oedipus and the man fight and he killed the man. He then finds a castle and becomes a king. Oedipus married the queen. To save his kingdom Oedipus must find the murderer or the previous king and remove him from the kingdom. While searching for the murderer Oedipus thinks that the man on the road that he killed was actually the previou s king. As he verifies his idea he learns that the king was actually his father and he is married to his mother, Jocasta the queen. When Oedipus goes to confront Jocasta he finds her dead body. He stabs himself in the eyeballs from the pain and grief that he has discovered. He is later banished from the kingdom (Sophocles, 969-1008). In the play Hamlet, Hamlet is the Denmark Prince. In the beginning, Hamlet is confronted by the ghost of his dead father, the previous king of Denmark. The ghost tells him that he was murdered by Hamlets uncle, Claudius, the current king. The ghost then asks him to avenge his death. Hamlet decides to act like he is crazy so he would have a better shot at killing him. While pretending to be crazy Hamlet has the Players act out a play that was similar to the murder of Hamlets father. Claudius stopped the play half way through. After he sent everyone away Claudius started to pray and Hamlet sneaks up on him about to avenge his fathers death. However, he decides not to kill him then because if Hamlet kills Claudius while he is praying then Claudius will go to heaven. Oedipus the King and Hamlet are very different when it comes to time period and setting although they were both set mostly in the castle. Oedipus is set in the time of Greek gods in the ancient city of Thebes. Hamlet, however, was set in the country of Denmark in a time when Catholicism was very strong (Hibbison). This is the case with an essay by Charles Gordon, When Irony Becomes Cynicism. Through his essay, one learns where irony’s roots started to grow into today’s monster that it is, and how irony is overused in television, radio and conversation. Gordon has skillfully and honestly shown how irony is perceived and used in today’s society. He fully shows that people use irony incorrectly, and it is to their disadvantage. Gordon has a particularly negative view on how much irony is used today. The thesis in his essay is not clearly stated, but his implied argument is that the overuse of irony has made society cynical. This negative view comes across to the reader through sentences such as the following, after Gordon has explained the technical meaning of irony, "In today’s context, irony is a sensibility that values cleverness and style above passion and commitment. It attacks bad taste by seeming to celebrate it. It mocks devotion to important causes by feigning devotion to trivial causes†¦ Which makes it sound pretty awful, and it can be." After the first few paragraphs in his essay, it becomes clear which side Gordon is on. However, he does show that he is not totally putting down irony, just the people using it incorrectly, "†¦ there is a line between irony and cheap cynicism that not everyone finds easily. His argument towards society’s use of irony is well presented through his strong sentences. Gordon also provides an example of a popular show that is almost based totally around this cynical-irony he is discussing. Gordon then begins to hint at the source of this type of overused irony, a part of society he rests some of the blame on: pop-culture.

This disease does not discriminate. People of all genders, race, ages, and nationalities are at risk (Internet). One of the problems resulting with the disease is that African-Americans, along with others, think that they are immune to this deadly virus. They believe that in America, it is a white gay disease. Although it originated in Africa, since white Americans brought it overseas, they are the only people who can get the disease. At least that is what African-Americans think. We as the ordinary people of the United States need to take education action. We need to show African-Americans that this is not some sort of Gods punishment on American white people. In our television ads, news articles, or any other way we distribute information about AIDS, we need to include the simple fact that this deadly virus does not discriminate. I believe that this will help lower the amount of African-American AIDS cases that we have in America. I believe that another problem facing the uninformed part of ordinary American society, is the fact that our children do not know enough about this deadly disease. Over 25,000 AIDS virus cases were reported involving children last year (Internet). Children can aquire the AIDS virus in two different basic fashions. For one, they can attain the deadly virus through a blood transfusion. Second of all, they can aquire the disease through being born into it. The only thing e can do for the children who need to have a blood transfusion is continue our blood screening medical advances, and continue the support of the doctors that make these medical advances. For the children who are born with the disease, well, we cannot do anything for these children exept treat them for the AIDS virus. These children were effected with the virus because of the fact that there parents did not take the proper safe sex precautions. Us ordinary people need to promote the education of parents about safe sex, and promote the education about safer blood transfusions. We need to make extra emphasis on this education because our children our the future of American society. Homosexuals these days seem to laugh in the face of danger. They laugh at oppressors,haters, and the AIDS virus. They believe that America has made so many medical advances, that they no longer need to worry about attaining the virus. They also believe that wearing a condom these days is a challenge to their manhood (Cunningham 703). Homosexuals were the original targets of the AIDS virus, as well as being labeled as the perpetrators of the disease in America. Ordinary society needs to continue the education of homosexuals by emphasizing that it still effects them as much as anyone else, if not more. The AIDS virus has swept through America like a giant sandstorm. We all know the basic facts about the virus, but all of us seem to be avoiding the statistics. Discrimination of Micronesians in Hawaii Essay Since the COFA (Compact of Free Association) Act was formalized between the Pacific Island nations of Micronesia and the United States in 1986, there have been rising influxes of Micronesian citizens that have the privilege of entering the U. S. without the need for a visa or time limit. These FAS (Freely Associated States) include the Republic of Palau, the Republic of the Marshall Islands and the Federated States of Micronesia. While there is no obligation to immigrate to a specific state within the U. S. , many choose to settle on Hawai’i. Due to its proximity to their home islands and tropical environment, the Micronesian population in Hawai’i has been steadily increasing during recent years. It is estimated that around 15,000 COFA migrants are currently residing in Hawai’i, where they subsequently face many barriers as new immigrants, including language, social and cultural barriers. Specifically, there is an ever-growing presence of Micronesian stereotyping and marginalization that is frequently exhibited by other ethnic populations in Hawai’i. Because they are seen as the â€Å"newest† population to arrive on the islands and the fastest growing, Micronesians are subject to many forms of discrimination. In recent years, our local community has been ill-equipped and misinformed about the Micronesian population. Consequently, our unfamiliarity has contributed to their isolation and discrimination within the Hawai’ian Islands. It is important for us as residents of Hawai’i to bridge the gap that exists between Micronesians and what we perceive as our own â€Å"local society†. Due to our society being misinformed and social control factors at work, we perceive Micronesians as being inept, destitute and imprudent. There are several barriers that hinder Micronesian assimilation within the islands. One such barrier is within the health care system. In Dr. Yamada’s article titled, â€Å"Discrimination in Hawaii and the Health of Micronesians†, he says Micronesians are often victims of â€Å"inferior care or denial of services†. There are instances of Micronesian patients that are denied services and being referred to another clinic, or being discriminated against due to their perceived lack of adherence to treatment plans. Personally, I believe that there is a kind of â€Å"ignorance† that health care providers bestow upon Micronesian patients. In 2006, I began working as a volunteer for the Kaka’ako homeless shelter and clinic started by Dr. Jill Omori that included inhabitants comprised mostly of Micronesian ethnicity. Many of them were unable to find a job and help themselves financially. Those individuals who lacked the means to support their family also sought refuge at the shelter. I observed that a lot of the older Micronesian shelter inhabitants could not speak English, and those who did only had limited basic knowledge and phrases that they used. What was surprising, however, was that most of the doctors and medical students who treated these patients did not having a working knowledge of the Chuukese language, which is spoken by the majority of the Micronesians. Many of these patients used the help of their children who were fortunate to attend public schools. Thus, a language barrier had existed, and still to this day, is continually a major factor in the fair treatment of health care delivery among Micronesians. In the health care system, it can be challenging to relay medical information from English into Chuukese. Pobutsky et. al. uggests having health education materials translated and readily available for Micronesian patients. Pobutsky also notes that having interpreters fluent in Chuukese is essential. Regarding denial of health services, Yamada talks about how COFA migrants were denied MED-QUEST (a Medicaid program) benefits in July 2010 by the Hawai’i State Administration. It was reinstated 4 months later because the denial was in direct violation of the Equal Protection clause of the 14th Amendment of the U. S. Constitution. Such discrimination is not only seen in our health care system, but also within the confines of social and economic settings. Yamada suggests that examining and countering â€Å"prevailing social forces† will help eliminate discrimination. By my personal interpretation, he is saying we must realize that social forces – such as the criminal justice system and the government – are shared by all of us as one single community in Hawai’i. By being responsible and looking out for one another regardless of race or ethnicity, we can close the social bridge that divide us. In other words, we must be proactive and bring to light the issues that face Micronesian immigrants who are treated unfairly. Another brief policy report from the Hawai’i Appleseed Center for Law and Economic Justice (HACLEJ) provides accounts of stigmatization by governmental leaders towards COFA migrants. The report further goes on to explain how there is an absence of interpreters available to help COFA migrants within labor, housing and court disputes. Within the context of the court system, it can be a challenge for someone convicted who does not have a working knowledge of the English language. HACLEJ emphasizes the need to â€Å"stimulate awareness, advocacy and action† in order to better address Micronesians living in Hawai’i. Several paths can be taken to address discrimination issues against Micronesians. Already, there are many advocates and groups that support Micronesians and other at-risk migrants. Some of these groups do not receive funding from the state of Hawai’i, and must rely on private funds to continue their work. There are also few research projects that involve Micronesians living in Hawai’i and thus there is little information in regards to ethnographic and qualitative studies. Additionally, surveys measuring Micronesians’ health needs and risk factors should be included within the context of how to better deliver health care. Within the political system, our lawmakers should be better informed and take more consideration into immigration affairs. Pobutsky et. al. gives several examples of health service programs that are currently in the process of addressing the language barriers and health concerns of Micronesians, but there is much more work to be done in order to achieve long-term success. Allocation of state and government funds should be directed towards creating more educational and social programs that can help better address disparities quite often seen with newly arrived immigrants. Based in part by my own personal experiences and also through research, many Micronesians are illiterate and lack a good work ethic to succeed in future endeavors. Because Micronesians are discriminated both in the job market and in school, they may perceive themselves as being unable to achieve success that is often seen with other ethnicities. Consequently many of them, especially Micronesian youths, engage in criminal behavior and illicit activities. My worry is that this cycle will manifest itself unchecked among these youths well into adulthood and create more harm than good within the criminal justice system of Hawai’i. As citizens of a diverse society in Hawai’i, we need to be more proactive and open-minded on issues that deal with the Micronesian population as a whole. Local perspectives that Micronesians are a kind of â€Å"deviance† on the islands and a â€Å"burden† to our society are obstructive to our continuous theme of the â€Å"Aloha spirit†. We must come together as a society and be more considerate and helpful to those who we might think less highly of. As long as institutions of power continue to ignore the problem of discrimination and disparity, then recent immigrants who include Micronesians will continue to face hardship. In our study of social control theory, there is the idea of â€Å"strain† that is frequently seen in societies that stress hard work and having a good education. More research efforts and studies must be done in order to better assess disparities present within the Micronesian population in Hawai’i, as well as having adequate funding by the state to support programs that meet the needs of the Micronesian community.
